1. Terms & Conditions for Use
The following Terms & Conditions shall govern the materials and services provided on the Site. The terms “you” and “user” as used in this Agreement refer to all individuals and/or entities accessing the Sites for any reason.
2. Binding Agreement
By using the Site, you accept these Terms & Conditions and agree to be legally bound by them. You should not use the Site if you have any objections to any of these Terms & Conditions.
3. Modification or Suspension of the Site
You agree that KORG Inc.("KORG") may, in its sole discretion, and at any time, modify, discontinue, or suspend its operation of this Site, or any part thereof, temporarily or permanently, without notice to you, and you agree that KORG will not be liable for any consequences of doing so.
4. Modifications to the Terms & Conditions of Use
KORG may make changes to these Terms & Conditions from time to time in its sole discretion, and will post any such changes on the Site. Each time changes are made, notice of these changes will be posted on the home page. Your continued use of the Site following the posting of changes constitutes your acceptance of any such changes.
5. Compliance with Laws
You agree that you shall comply with all applicable laws, statutes, treaties, rules and regulations relating to the Site, including, without limitation, intellectual property laws and privacy laws.
You waive any moral rights, neighboring rights, and/or similar provisions of law that may be applicable to you. You warrant that the Submissions do not violate any right of any third party.
6. Copyright Disclaimer
If you are not the copyright holder of a musical work or a sound recording and you have not received permission from the copyright holder(s), you may be violating applicable laws if you produce and distribute CDs or other sound recordings, broadcast, publicly perform, sell, or make other unauthorized use of the copyrighted works. Infringers of copyrighted works may be liable for monetary damages and other penalties. KORG. can not assume any responsibility for damages, etc. caused by copyright infringement. If you are unsure about your rights, please consult a copyright attorney.
YOU UNDERSTAND AND AGREE THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY LICENSES, CONSENTS, WAIVERS, PERMISSIONS AND/OR OTHER AUTHORIZATIONS THAT MAY BE REQUIRED FOR THE USE OF ANY MUSICAL WORKS AND/OR SOUND RECORDINGS.
YOU EXPRESSLY UNDERSTAND AND AGREE THAT UNDER NO CIRCUMSTANCES WILL KORG BE LIABLE FOR ANY INFRINGEMENT COMMITTED BY YOU USING ANY KORG PRODUCT; KORG INC. SHALL NOT BE LIABLE FOR ANY DAMAGES, INCLUDING WITHOUT LIMITATION, ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, ANY LOST PROFITS, LOSS OF GOODWILL, OR ANY OTHER DAMAGES, HOWSOEVER CAUSED, AND ON ANY THEORY OF LIABILITY, RELATING TO OR RESULTING FROM THE USE OF, OR THE INABILITY TO USE, ANY OTHER KORG PRODUCT.
7. Protection of Intellectual Rights and License
You acknowledge that content available through the Site, including, without limitation, content in the form of text, graphics, software, music, sound, photographs, and videos (collectively, the “Intellectual Property”), is protected by copyright law, trademark law, patent law, and/or other proprietary rights and laws. Except as expressly authorized by KORG. herein, you agree not to copy, modify, rent, lease, loan, sell, assign, distribute, license, reverse engineer, or create derivative works based on the Site or any content (including, without limitation, any software) available through the Site.
With respect to the content on this Site not uploaded by users, you are hereby granted a nonexclusive, nontransferable, revocable, limited license to view, copy, print, and distribute content retrieved from the Site for your personal, noncommercial purposes, provided that you do not remove or obscure the copyright notice or other notices displayed on or included with the content.
You may not frame any trademark, logo, or other proprietary information on this Site without the express, prior written consent of KORG. Except as expressly provided in the Agreement, nothing contained in the Agreement or on the Site shall be construed as conferring any other license or right, expressly, by implication, by estoppel, or otherwise. Any rights not expressly granted herein are reserved.
None of the material contained on this Site (including all software, HTML code and other code) may be reverse-engineered, disassembled, decompiled, transcribed, stored in a retrieval system, translated into any language or computer language, retransmitted in any form or by any means (electronic, mechanical, photo-reproduction, recordation or otherwise), resold or redistributed without the prior written permission of KORG.

Reference on this website or in any materials KORG. owns to any recording artist or song title is to describe content sounds only. There is no affiliation or association with any artist, nor any recommendation or endorsement of any sort of KORG. by any listed recording artist, composer, lyricist, recording company or any third party. No such affiliation, association, recommendation, endorsement or other relationship should be inferred or implied.
9. Trademarks/Service Marks
The trademarks, logos and service marks, including those listed above, displayed on the Site (collectively the “Marks”) identify KORG’s products and services, and inform the public that KORG is the source of those products and services. Nothing contained on the Site should be construed as granting any right or license to use any Mark displayed on the Site. Your misuse of any Mark is strictly prohibited, including without limitation, your use of the Marks in any of the following ways:
To identify materials or services that are not materials or services KORG provides;
In, as, or part of your own trademarks or services marks;
In any manner likely to cause confusion;
In a manner that implies inaccurately that KORG Inc. sponsors, endorses or is otherwise connected with your products, services or other activities; or

10. Limitations of Liability
YOU EXPRESSLY UNDERSTAND AND AGREE THAT UNDER NO CIRCUMSTANCES WILL KORG BE LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, ANY LOSS OF USE, LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, COST OF PROCUREMENT OF SUBSTITUTE SERVICES, OR ANY OTHER INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, HOWSOEVER CAUSED, AND ON ANY THEORY OF LIABILITY, WHETHER FOR BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE AND STRICT LIABILITY), OR OTHERWISE RESULTING FROM THE USE OF, OR THE INABILITY TO USE, THE SITE OR ANY OTHER MATTER RELATING TO THE SITE. KORG DOES NOT MAKE ANY WARRANTY THAT THE SITE WILL MEET YOUR REQUIREMENTS, OR THAT ACCESS TO THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS, IF ANY, WILL BE CORRECTED. KORG MAKES NO WARRANTIES AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE OR AS TO THE ACCURACY, QUALITY, OR RELIABILITY OF ANY INFORMATION OBTAINED THROUGH THE SITE.

12. Indemnification
You agree to indemnify and hold harmless KORG, its directors, officers, employees, agents, co-branders, subsidiaries, parents, and affiliates, from and against any and all liability, losses, claims, demands, disputes, damages, and costs of any kind, including, without limitation, reasonable attorneys' fees and costs of litigation resulting from or in any way connected with your use of the Site; Content you submit, post, or transmit through the Site; your breach of the Agreement; and your connection to the Site.
13. Severability of Agreement
If any provision of the Agreement is found by a court or other binding authority to be invalid, you agree that every attempt shall be made to give effect to the parties' intentions as reflected in that provision, and the remaining provisions contained in the Agreement shall continue in full force and effect.
14. Applicable Laws
This Terms of Use shall be governed by and construed in accordance with the laws of Japan. Any dispute arising out of this Terms of Use hereunder shall be subject to the exclusive jurisdiction of the Tokyo District Court.

SOFTWARE LICENSING AGREEMENT
PLEASE READ THIS CAREFULLY BEFORE YOU OPEN THE DISK PACKAGE.
THE FOLLOWING IS THE SOFTWARE LICENSING AGREEMENT BETWEEN YOU, THE END USER, (REFERRED TO IN THIS AGREEMENT AS “YOU” OR “YOUR”) AND KORG INC. (REFERRED TO IN THIS AGREEMENT AS “KORG”) FOR YOUR USE OF THE SOFTWARE IN THIS PRODUCT AND OUR SUPPORT SERVICES TO YOU. THE ENCLOSED SOFTWARE PROGRAM IS LICENSED BY KORG TO YOU AS THE ORIGINAL PURCHASER FOR USE ONLY ON THE TERMS SET OUT HEREIN. BY USING (INSTALLING OR MAKING A BACKUP COPY OF) THE SOFTWARE, YOU ARE AGREEING TO THE TERMS SET OUT IN THIS AGREEMENT. IT IS THEREFORE IMPORTANT THAT YOU READ THIS LICENSING AGREEMENT WITH CARE BEFORE USING THE SOFTWARE.
1. GRANT OF LICENSE AND COPYRIGHT
Korg grants you, the original purchaser, the non-exclusive right to use the program and the data file constituting this software and the upgrade program(s) as well as the data file(s) which may be distributed to you from time to time (hereinafter referred to collectively as “Licensed Program”) on associated Korg product(s) and/or a single computer under your control and used by only one person at a time.
All references to the Licensed Program shall mean the object code only of the program(s) comprising the Licensed Program.
The Licensed Program and any manuals or other written documentation supplied with the Licensed Program belongs to you. The ownership of the rights to and the copyright of the Licensed Program itself (whether supplied via a storage device, diskette, download from the Internet or otherwise) and the copyright of the contents of any manual or other written document belong to Korg.
Korg reserves the right to make modifications to the Licensed Program and to the support services set out in clause 7 of this agreement (referred to in this agreement as “the Services”) without prior notification to you.
2. RESTRICTIONS
The Licensed Program contains copyrighted information. For the purpose of protecting such copyrights, you may not decompile, disassemble, reverse engineer, or otherwise reduce the Licensed Program to a human-perceivable form (save as may be permitted by law).
You may not duplicate, alter, modify, rent, lease, resell, assign, loan, sub-license, distribute the whole or part of the Licensed Program, or make derivative works based on what is contained in the Licensed Program. (However, it is not included in this restriction that you create derivative works based on the data file(s).)
You may not transfer the Licensed Program to another computer through a network.
You may make only one backup copy of the Licensed Program, which you are only allowed to use for the purpose of restoring the Licensed Program.
3. TERMINATION
This agreement takes effect on the date you have received the Licensed Program. The license granted in this agreement will terminate automatically without notice from Korg in the event that you breach any provision of this agreement or in any way infringe Korg’s copyright in the Licensed Program.
In such event you must destroy the Licensed Program and its backup copy immediately.
4. PRODUCT WARRANTY
Korg warrants that the Licensed Program when properly used will provide the facilities and functions as described in the accompanying documentation but does not warrant that the operation of the Licensed Program will be uninterrupted or error-free.
This warranty shall however only apply to the latest version of the Licensed Program (provided that Korg has reasonably made such version available to you) and shall not apply to any previous version or versions of the Licensed Program.
Korg’s obligation and your exclusive remedy under the warranty mentioned above, is limited either:
(a) to Korg at its own expense using all reasonable endeavours to rectify any non-conformance with the warranty by repair (by way of a patch, work around, correction or otherwise) within a reasonable period of time or,
(b) to a refund of the license fee paid (if any) if in Korg’s reasonable opinion it is unable to rectify such non-conformance within a reasonable timescale or at an economic cost, whereupon this agreement and the license created by this agreement shall terminate.
The warranties provided in this clause 4 is limited to the product purchased from an authorized retailer, distributor or download from the Korg website.
5. LIMITATIONS ON LIABILITY
You agrees that the express obligations and warranties made by Korg in this Agreement are (so far as is permitted by law) in lieu of and to the exclusion of any other warranty, condition, term, undertaking or representation of any kind, express or implied, statutory or otherwise, relating to anything supplied or services provided under or in connection with this Agreement including (without limitation) any warranty as to the condition, quality, performance, merchantability or fitness for purpose of the Licensed Program and the Services or any part of them.
Korg, in no event, will be liable for the direct, derivative, collateral or consequential damage caused by the use of or the inability of using the Licensed Program (including but not limited to damage of data, lost commercial profit, interruption of work, lost commercial information), regardless of the degree of damages, and even if Korg was aware of the possibility of such damages or the possibility of a claim for damage from a third party in advance.
Nothing in this agreement shall affect the statutory rights of any person dealing with Korg as a consumer.
6. THIRD PARTY SOFTWARE
Korg may on occasions supply software programs, data files and/or documentation belonging to a third party or parties (hereinafter collectively referred to as “Third Party Software”).
If supplied in conjunction with any Korg instrument or equipment, such Third Party Software shall only relate to the non-essential functions of such instrument or equipment.If Third Party Software has been supplied (whether in conjunction with any Korg instrument or equipment, or as a stand-alone product) a notice to that effect will be contained with or on the disk supplied and in such circumstances Korg shall be deemed to be acting as the agent only of the supplier of such Third Party Software.
In the event that Third Party Software is supplied, you agree to be bound by and to observe any terms and conditions relating to the use of such Third Party Software.
Korg shall not be obliged to provide support services for any Third Party Software supplied (whether relating to operating methods, defects, or otherwise).
Korg provides no warranty in relation to any Third Party Software supplied and all warranties whether express or implied as to the condition, quality, performance, merchantability or fitness for purpose of the Third Party Software or any part of the same are (in so far as may be permitted by law) hereby excluded.
Korg furthermore disclaims all responsibilities for direct, derivative, collateral or consequential damages caused by the use of or the inability of using the Third Party Software (including but not limited to damage of data, lost commercial profit, interruption of work, lost commercial information), regardless of the degree of damages, and even if Korg was aware of the possibility of such damages in advance.
7. SUPPORT SERVICES
Support services such as technical support or upgrade support for this product are provided according to the support service policies of Korg’s distributors applicable in each country.
Korg reserves the right to amend any such policies from time to time in its absolute discretion.
8. GENERAL
The license created by this agreement is personal to you and you may not assign or otherwise transfer your rights or obligations under this agreement without the prior written consent of Korg.
If any part of this Agreement is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part shall be severed from the remainder of this Agreement which will continue to be valid and enforceable to the fullest extent permitted by law.
This agreement is governed by and construed under the local law of the country where this product has been purchased.
You hereby agree to the exclusive jurisdiction and venue of the aforementioned territory, without regards to conflicts of law provisions.
Headings have been included for convenience only and shall not be used in construing any provision in this Agreement.
Sound Library Software Licensing Agreement
Please read this carefully before you download the software. The following is the software licensing agreement between you, the end user, (referred to in this agreement as "you" or "your") and Korg Inc. (referred to in this agreement as "Korg") for your use of the software in this product and our support services to you. The software program is licensed by Korg to you as the original purchaser for use only on the terms set out herein. By using (installing or making a backup copy of) the software, you are agreeing to the terms set out in this agreement. It is therefore important that you read this licensing agreement with care before using the software. If you do not agree to the terms set out in this agreement, please do NOT proceed with downloading.
1. Grant of license and copyright.
Korg grants you, the original purchaser, the non-exclusive right to use the program and the data file constituting this software and the upgrade program(s) and the data file(s) which may be distributed to you from time to time (hereinafter referred to collectively as "Licensed Program") on related Korg Product(s) and/or a single computer which is under your control and which allows use by one person only at a time. All references to the Licensed Program shall mean the object code only of the program(s) comprising the Licensed Program. The ownership of the software in which the Licensed Program is recorded and any manuals or other written documentation supplied with the Licensed Program belongs to you. The ownership of the rights to and the copyright of the Licensed Program itself (whether supplied via a disk, memory stick or other storage device, diskette, download via the internet or otherwise) and copyright in the contents of any manual or other written document belong to Korg or Korg’s development partners. Korg reserves the right to make modifications to the Licensed Program and to the support services set out in clause 7 of this agreement (referred to in this agreement as "the Services") without prior notification to you.
2. Restrictions.
The Licensed Program contains copyrighted information. For the purpose of protecting such copyrights, you may not decompile, disassemble, reverse engineer, or otherwise reduce the Licensed Program to a human-perceivable form (save as may be permitted by law). You may not duplicate, alter, modify, rent, lease, resell, assign, loan, sub-license, distribute the whole or part of the Licensed Program, or make derivative works based on what is contained in the Licensed Program. The Licensed Program can, of course, be used for commercial or non-commercial music and audio productions, and such usage is not considered a derivative work as listed above.
3. Termination.
This agreement takes effect on the date you have received the Licensed Program. The license granted in this agreement will terminate automatically without notice from Korg in the event that you breach any provision of this agreement or in any way infringe Korg's copyright in the Licensed Program. In such event you must destroy the Licensed Program immediately.
4. Product warranty.
Korg warrants that the Licensed Program when properly used will provide the facilities and functions as described in the accompanying documentation but does not warrant that the operation of the Licensed Program will be uninterrupted or error-free. This warranty shall however only apply to the latest version of the Licensed Program (provided that Korg has reasonably made such version available to you) and shall not apply to any previous version or versions of the Licensed Program.
Korg's obligation and your exclusive remedy under the warranty mentioned above is limited either:
(a) to Korg at its own expense using all reasonable endeavours to rectify any non-conformance with the warranty by repair (by way of a patch, work around, correction or otherwise) within a reasonable period of time or,
(b) to a refund of the license fee paid (if any) if in Korg's reasonable opinion it is unable to rectify such non-conformance within a reasonable timescale or at an economic cost, whereupon this agreement and the license created by this agreement shall terminate. In the event that there is any physical defect in the download or storage device (memory stick, disk etc on which the Licensed Program is supplied, Korg will exchange the defective disk with a non-defective disk of the same model at no charge provided that you have notified Korg of the existence of such defect within 28 days from the date you have received the provided always that Korg shall not be liable to replace the disk in the event that the defect is attributed to accident, abuse, misuse or such other causes outside of Korg's control.
The warranties provided in this clause 4 are limited to the product purchased from an authorized retailer, distributor or download from Korg’s offical website.
5. Limitations on liability.
You agrees that the express obligations and warranties made by Korg in this Agreement are (so far as is permitted by law) in lieu of and to the exclusion of any other warranty, condition, term, undertaking or representation of any kind, express or implied, statutory or otherwise, relating to anything supplied or services provided under or in connection with this Agreement including (without limitation) any warranty as to the condition, quality, performance, merchantability or fitness for purpose of the Licensed Program and the Services or any part of them.
Korg, in no event, will be liable for the direct, derivative, collateral or consequential damage caused by the use of or the inability of using the Licensed Program (including but not limited to damage of data, lost commercial profit, interruption of work, lost commercial information), regardless of the degree of damages, and even if Korg was aware of the possibility of such damages or the possibility of a claim for damage from a third party in advance. In the event that Korg offers an updated or upgraded version of the Licensed Program to you at any time, Korg's obligation (and that of its distributors and dealers) to support previous versions of the Licensed Program shall cease 28 days following such updated or upgraded version being made available to you.
Nothing in this agreement shall affect the statutory rights of any person dealing with Korg as a consumer.
6. Third Party Software.
Korg may on occasions supply software programs, data files and/or documentation belonging to a third party or parties (hereinafter collectively referred to as "Third Party Software"). If supplied in conjunction with any Korg instrument or equipment, such Third Party Software shall only relate to the non-essential functions of such instrument or equipment. If Third Party Software has been supplied (whether in conjunction with any Korg instrument or equipment, or as a stand-alone product) a notice to that effect will be contained with or on the disk supplied and in such circumstances Korg shall be deemed to be acting as the agent only of the supplier of such Third Party Software.
In the event that Third Party Software is supplied, you agree to be bound by and to observe any terms and conditions relating to the use of such Third Party Software. Korg shall not be obliged to provide support services for any Third Party Software supplied (whether relating to operating methods, defects, or otherwise). Korg provides no warranty in relation to any Third Party Software supplied and all warranties whether express or implied as to the condition, quality, performance, merchantability or fitness for purpose of the Third Party Software or any part of the same are (in so far as may be permitted by law) hereby excluded.

7. Support services.
Support services such as technical support or upgrade support for this product are provided according to the support service policies of Korg's distributors applicable in each country. Korg reserves the right to amend any such policies from time to time in its absolute discretion.
When the Licensed Program or Korg Product(s) to which it relates is discontinued, the support services will be terminated after 12 months from such discontinuation.
The support referred to in this clause is limited to the products purchased from an authorized retailer or distributor. In the event that Korg offers an updated or upgraded version of the Licensed Program to you at any time, Korg's obligation (and that of its distributors and dealers) to support previous versions of the Licensed Program shall cease 28 days following such updated or upgraded version being made available to you.

KRONOS/NAUTILUS Series Sound Library Software Licensing Agreement (EXs Expansion Sample Series)
THE FOLLOWING IS THE LICENSING AGREEMENT BETWEEN YOU, THE END USER (REFERRED TO IN THIS AGREEMENT AS "YOU" OR "YOUR"), AND KORG INC.
(REFERRED TO IN THIS AGREEMENT AS "KORG") FOR YOUR USE OF THE KRONOS/NAUTILUS SERIES SOUND LIBRARY SOFTWARE (REFERRED TO IN THIS AGREEMENT AS "SOFTWARE") AND OUR SUPPORT SERVICES TO YOU. THE SOFTWARE IS LICENSED BY KORG TO YOU FOR USE ONLY IN ACCORDANCE WITH THE TERMS SET OUT HEREIN. BY PURCHASING OR OTHERWISE OBTAINING THE SOFTWARE LICENSE, YOU ARE AGREEING TO THE TERMS SET OUT IN THIS AGREEMENT. IT IS THEREFORE IMPORTANT THAT YOU READ THIS LICENSING AGREEMENT WITH CARE BEFORE OBTAINING THE SOFTWARE LICENSE. IF YOU DO NOT AGREE TO THE TERMS SET OUT IN THIS AGREEMENT, PLEASE DO NOT PURCHASE THE SOFTWARE.
No Refund
Purchasing the Software License cannot be reversed. All Software is available for your evaluation as a demonstration version, fully functional but with regular audio interruptions. Some demonstration versions may be included with the system software; others may be separately installable. This allows you to test the Software and be sure that it performs as advertised and is suitable for your purposes, so that when you purchase the Software License you do so fully aware of the Software's operations. If you have not tested the Software in demo mode, you must test the Software first to be sure of your purchase. There are no refunds for this Software License once the purchase is made and the authorization code is issued to you, even if you have not entered the authorization code into the KRONOS/NAUTILUS series products.
Note also that, once the authorization code is entered, there is no de-authorization process.
Grant of License and Copyright
You are granted the right to use the Software solely pursuant to the terms set forth in this agreement. The ownership of the rights to and the copyright of the Software itself (whether supplied via a disk (CD-ROM), diskette, download via the internet or otherwise) and copyright in the contents of any manual or other written document belong to Korg or Korg’s development partners. You have, and acquire, no right, title or interest in the Software or the contents of any manual or other written document.
Restrictions and Transfer
The Licensed Program contains copyrighted information. For the purpose of protecting such copyrights, you may not decompile, disassemble, reverse engineer, or otherwise reduce the Licensed Program to a human-perceivable form (save as may be permitted by law). You may not duplicate, alter, modify, rent, lease, resell, assign, loan, sub-license, distribute the whole or part of the Licensed Program, or make derivative works based on what is contained in the Licensed Program. The Licensed Program can, of course, be used for commercial or non-commercial music and audio productions, and such usage is not considered a derivative work as listed above.
The license granted to the end-user for the Sound Data is attached to the end-user’s account on the Korg online store, and is limited to use of the Sound Data on no more than three (3) Korg Products which the end-user owns or controls and which are registered to the user’s account, and as permitted by the Usage Rules set forth in the Korg online store Terms of Service. Note that the license for Sound Libraries which are factory-installed on a KRONOS/NAUTILUS series product is attached to the product, and not to the user account. These factory-installed Sound Libraries may only be authorized on the product on which they were originally installed.
It is not possible to cancel, remove, or revoke the authorization of the KRONOS/NAUTILUS series products once the authorization is completed. Therefore, if such an individual Korg Product is subsequently sold to a different user, the sold unit no longer counts towards the maximum of 3 Korg Products mentioned above, but the registration is not transferred to the new owner’s user account.
Limitations on Liability
Korg shall not be liable for errors contained in the Software. Korg will in no event be liable for any direct, indirect, special, incidental or consequential damages whatsoever (including lost profits, lost data, or business interruption) related to any use of, or inability to use, the Software.
Product Warranty
Korg warrants that the Software when properly used will provide the facilities and functions described in the accompanying documentation, but does not warrant that the operation of the Software will be uninterrupted or error-free. This warranty shall however only apply to the latest version of the Software (provided that Korg has reasonably made such version available to you) and shall not apply to any previous version or versions of the Software.
Korg's obligation, and your exclusive remedy under the warranty mentioned above, is limited either:
(a) to Korg at its own expense using all reasonable endeavors to rectify any non-conformance with the warranty by repair (by way of a patch, work around, correction or otherwise) within a reasonable period of time or,
(b) to a refund of the License fee paid (if any) if in Korg's reasonable opinion it is unable to rectify such non-conformance within a reasonable timescale or at an economic cost, whereupon this agreement and the License created by this agreement shall terminate.
Support Services
Support services for the Software are provided according to the support service policies of Korg's distributors in the country where the applicable KRONOS/NAUTILUS series product is sold. Korg reserves the right to amend any such policies from time to time in its absolute discretion. If and when the Software or the KRONOS/NAUTILUS series product to which it relates is discontinued, the support services will be terminated after 12 months from such discontinuation.
Termination
Korg may terminate your License upon notice for failure to comply with any of these License Terms. Upon termination, you must immediately terminate your use of the Software.
